26 legal acts incorporated into the EEA Agreement

Published 10-07-2014
On 9 July 2014, the EEA EFTA States and the European Union adopted seven Joint Committee Decisions (JCDs) by written procedure incorporating 26 EU legal acts into the EEA Agreement. Among these were the Directive on patients’ rights in cross-border healthcare, the Connecting Europe Facility (CEF) and the Rights, Equality and Citizenship Programme.

One of the JCDs adopted by written procedure was the supplementary package on adaptations to the EEA Agreement, which were necessary due to Croatia’s accession to the EU.

The Directive on the application of patients’ rights in cross-border healthcare provides clarity about the rights of patients who seek healthcare in another EEA country. The new rules clarify that citizens of one EEA Member State can be reimbursed for healthcare received in another Member State, as long as the type of treatment and costs would have been covered in their own country. Authorities may require patients to seek prior authorisation for treatment requiring an overnight hospital stay or highly specialised and cost-intensive healthcare. Refusals will need to be justified according to a restricted list of possible reasons.

Two EU programmes were also incorporated into the EEA Agreement on 9 July. Liechtenstein will take part in the Rights, Equality and Citizenship Programme and Norway will participate in the telecommunications part of the CEF. Iceland will participate in both of these programmes.

The written procedure is an exceptional procedure envisaged for the adoption of JCDs on important and urgent matters outside the regular EEA Joint Committee meetings, where such decisions are usually adopted.
